Can a person appeal delivery to the CCC: lawyer's recommendations

According to lawyer Orest Gladyo, if a person gets into a vehicle of TCC employees without an appropriate protocol, he actually gives voluntary consent to delivery to the military enlistment office.

A person can refuse to be delivered to the territorial recruitment and social support center. However, if a person gets into a vehicle of TCC employees or the police without a protocol, he thereby gives voluntary consent to delivery. This was reported by Orest Gladyo, a specialist at the OLSON law firm.

In the event of violations of military registration rules or discrepancies between the military registration document and the data in the registers, the CCC notification groups and the police may suggest that the conscript go to the CCC and the SP to be registered for military service, undergo a medical examination to determine suitability for military service, and clarify their personal data or data in the military registration document.

“You have every right to refuse such an offer. In order to confirm your offer, employees of the CCC and the SP can hand you a summons, which you can also refuse if you believe that your rights are being violated,” the specialist said.

He noted that administrative detention and drawing up a protocol take place in a certain order. If a person gets into a vehicle of CCC employees without drawing up a corresponding protocol of administrative detention, he actually gives voluntary consent to be delivered to the CCC.

“In this case, it is impossible to challenge the actions of CCC employees in any way. Of course, we exclude from this rule cases of illegal actions of employees of the CCC and the SP, which are associated with the use of physical or psychological violence against such a person,” added Orest Gladyo.
