A summons sent by mail will be considered delivered: the Ministry of Defense stated the condition
0 < p>According to the spokesperson of the department Dmytro Lazutkin, now a summons can be considered served if a person has put a personal signature.
After July 16, summonses in Ukraine can begin to be sent by regular mail after the end of the 60-day period established by law for the clarification of military registration data. This was stated by the speaker of the Ministry of Defense of Ukraine, Dmytro Lazutkin, on the air of the telethon.
“Subpoenas will indeed be sent by registered mail after July 16. Currently, the summons is considered served if the person signed it personally – then yes,” the department representative emphasized.
Lazutkin separately commented on the algorithm for serving summonses by mail after July 16.
“A registered letter arrives, a person either receives it under signature, or refuses to sign it again, or it is returned and thus it is again considered that it was delivered… If the person was not physically there and returns, then the mechanism of administrative offense,” said the press secretary of the Ministry of Defense.
It was previously noted that a summons to the door will not be considered legally served. At the same time, the summons can be called served if it is delivered personally to the person to whom it is addressed. It must also bear a signature of receipt. Otherwise, this document will not have legal force.
Recall that on June 14, the press service of the Volyn OTCC and SP named cases when men can ignore the summons.
