Martial law: can a 25-year-old boy who is completely blind in one eye be drafted

Due to the war started by the Russian Federation, general mobilization continues in Ukraine and martial law has been declared. During this period, conscripted men aged 18 to 60 who receive summonses are subject to conscription.

The expert explained that the Military Medical Commission (MMC) determines the degree of suitability for military service based on a comparison of the diseases present in a person with those diseases that are available in the Schedule of Diseases of the Order of the Ministry of Internal Affairs No. 402.

According to Donchak, now almost all articles of the Schedule of Diseases are divided into the following items:

  • a – unfit for military service with exclusion from military registration;
  • b – suitable for service in military support units, TCCs and joint ventures, higher education institutions, educational centers, institutions (institutions), medical units, units of logistics, communications, operational support, security;
  • c – suitable for services.

The lawyer emphasized that complete blindness in one eye is Article 31 of the Schedule of Diseases.

“As stated in this article, blindness in one or both eyes; the absence of one or both eyeballs is point “a”, that is, with such a diagnosis, a person is unfit for military service with exclusion from military registration. At the same time, as we can see, in the list of diseases for Article 31, it does not matter at all whether it is complete blindness of one eye or the absence of one eye,” Donchak said.

He emphasized , that this article means ineligibility for military service with exclusion from military registration.

“With such an article they do not mobilize. At the same time, Article 31 clearly states in which cases point “a” must be established. Therefore, with the blindness of one eye, the VLK cannot write anything else in the resolution except Article 31-a,” the expert explained.
