A car can be seized for the needs of the army if the family owns more than one car. They will take the vehicle that is more suitable for the Armed Forces.

The TCC, SBU and other special services will seize personal transport from Ukrainians for the needs of the army. This was reported to the Ministry of Defense of Ukraine. The norm came into force on May 18, when the law on mobilization came into force, informs the publication “Economic News”. and road construction machines, as well as about agricultural machinery.

Employees of the TCC, regional bodies of the Security Service of Ukraine, or units of the State Security Service may seize vehicles during mobilization based on the decisions of local state administrations.

Military transport duty applies to:

• central and local executive power bodies, other state bodies, local self-government bodies;
• enterprises, institutions and organizations, including railways, ports, wharves, airports, oil depots, gas stations of the road industry;
• enterprises, institutions and organizations that ensure the operation of vehicles;
• ordinary citizens, if they own more than one vehicle.

The return of the vehicle after the announcement of demobilization is carried out within 30 days on the basis of acts of acceptance and transfer. The document contains information about the owners, technical condition, residual value and other necessary information that allows vehicles to be identified.

One of the two cars will be taken away

The military transport duty provided for by the law on mobilization was primarily of interest to car owners. How will the procedure take place, and from whom will the car be taken for the needs of the army?

According to lawyer Yevgeny Zurnadzha, the car can be confiscated only if the family has more than one vehicle. And if the car is suitable for the tasks of the Armed Forces.

“I think that the Ministry of Defense will form lists of needs for the coming year, will send tasks to the TCC. The military commissars, having access to all databases, will see which of the citizens have several vehicles registered on their territory, draw up an act of acceptance-transfer, assess the property and take away the car.

Abuse or use this norm as they can also punish, but the question is, what will they do with the complaints that will inevitably go,” says Zurnadzhi.

The expert reminds that the base “Oberig”, which was accessed by the employees of the military commissariat, the SBU and where it is stored personal data of citizens aged 18-60, combines several databases.

In particular, the service centers of the Ministry of Internal Affairs of Ukraine and the State Security Service, where you can get information about who owns which family and how many cars.

“The TCC and the SBU have access to this information. If a specific car is suitable for tasks at the front, and it is not the only vehicle in the family, the car can be seized and transferred to the needs of the army.

I think there will not be mass cases, since the sedan, let's say, is taken will not become, they are not suitable for the needs of the army. Unless some general is being driven. But they can pay attention to jeeps,” says Zurnadzhi.

Instead of a car, the money will be returned

Before removing the car, the relevant authorities must draw up an act of acceptance and transfer, as well as conduct an assessment of the value of the property. If the owner believes that the price is low, he can appeal the decision in court.

“Three days are enough to seize the car. It will take up to six months to review the vehicle's valuation. It is clear why the question has become relevant.

A car is a bargaining chip in war. In 2022-2023, the volunteers bought all the cheap transport that is suitable for the army, and the situation is not easy.

Therefore, if a person does not want to give the car, it will still be taken away and will not be asked. And in a few years, the state will return the money for the seized vehicle,” continues the expert.

The car is returned one month after demobilization. There is also a procedure for refunding funds approved during the evaluation.

“No one will inform you if the car is no longer available. After drawing up the act of acceptance and transfer, the car is no longer in your possession. You transfer it to the property of the state. And they can return the money, a mechanism for this is provided,” the expert summarizes.
